General Conditions of Sale

Customer Service

For any information, questions, or support requests, customers can contact Customer Service at info@iurace.it. We will respond as quickly as possible.

Here is the English translation:

1. General Information

These General Terms and Conditions of Sale (“GTCS”) govern the retail sale of food products under the “Iurace” brand, carried out in Italy and abroad by Impresa Individuale Gerace Pasquale, with registered office in Contrada Vermica snc, Isola di Capo Rizzuto (KR), addressed to customers who purchase products through the website or by email.

“Iurace” invites the Customer to read these GTCS carefully, available at any time on the website.

2. Definitions

Seller: Impresa Individuale Gerace Pasquale.
Website: www.iurace.it.
Goods/Products: food products under the Iurace brand.
Consumer: a natural person purchasing for non-business or non-professional purposes.
Professional: a natural or legal person acting in a commercial, artisanal, or professional capacity.
Customer(s): adult consumers or professionals purchasing products to whom these GTCS apply.

3. Subject of the Contract

The presentation of products on the website constitutes an offer to the public addressed to adult natural persons and legal entities, excluding those operating in the business or professional trade sector.

The product characteristics are described on the website with images for illustrative purposes only and not binding.

The submission of an order is considered a contractual proposal by the Customer. The order confirmation from the Seller will be sent via email. The contract is deemed concluded at the time of delivery.

4. Applicable Law

The contract is governed by these GTCS, by the Consumer Code (Legislative Decree 206/2005), Legislative Decree 70/2003, and the Italian Civil Code where applicable, as well as, for sales to other EU countries, by Directive 2011/83/EU and related national regulations.

5. Order Cancellation

The Customer may cancel the order as long as the shipping process has not yet begun, without additional costs.

6. Prices, Taxes, and Shipping Costs

Italy: prices are in Euro, inclusive of VAT, packaging, and containers.

Shipping Costs

  • Free for orders over €150 (Italy only).

  • €4.90 for orders under €150.

Delivery times: 1–4 business days from order confirmation.

7. Payment Methods

Orders can be paid exclusively online via Stripe, a secure digital payment platform. Accepted methods include:

  • Credit and debit cards (Visa, Mastercard, American Express, etc.)

  • Apple Pay

  • Google Pay

  • Other methods supported by Stripe (shown at checkout)

8. Invoices

Invoices are mandatory for professionals upon request at the time of the order.

9. Customer Obligations and Responsibilities

The Customer must provide complete and accurate data for delivery and must not use the service for fraudulent or unlawful purposes.

10. Delivery Methods

Delivery is made to the address provided by the Customer, at the Seller’s risk until delivery.

11. Delivery Areas

Italy: deliveries throughout the national territory.

12. Product Unavailability

In case of temporary unavailability, the Customer will be informed and may choose to cancel or wait.

13. Right of Withdrawal

Italy and EU: the Consumer Customer has the right to withdraw from the contract within 14 days from the delivery date.

Return conditions:

  • Products must be intact, sealed, and unopened, in the original packaging

  • Return shipping costs are borne by the Customer

  • Communication must be sent via email to info@iurace.com, indicating the order number and products to be returned

⚠️ Products that are opened, damaged, or without the original seal will not be accepted.

Refund:

  • Within 14 days from receipt and verification of returned products

  • Refunded amount: value of purchased products (excluding shipping costs)

  • Same payment method used by the Customer

14. Damaged Products, Errors, or Failed Delivery

Damaged or incorrect products:
Report to info@iurace.it within 48 hours of delivery, with photos of the products and packaging. The Seller will replace the product or refund the amount, including any incurred shipping costs.

Failed delivery:
If the shipment does not arrive within the indicated timeframe, the Customer must contact info@iurace.it.
The Seller will start an investigation with the courier within 7 business days.

In case of confirmed loss, the Customer may choose between:

  • Full refund of the order

  • Shipment of a new order at no additional cost

Delivery reported as completed by the courier:
If the courier confirms delivery to the specified address, responsibility for the package passes to the Customer. In case of theft or loss after delivery, the Customer must file a report with the competent authorities and/or a claim with the courier. The Seller will provide assistance but will not be required to refund or replace the products.

15. Legal Warranty

The 2-year legal guarantee of conformity applies to EU customers.

16. Complaints

Any complaints must be sent to info@iurace.it.

17. Protection of Minors

Purchases are allowed only to adults or under supervision.

18. Intellectual Property

All website content is protected by copyright.

19. Applicable Law and Jurisdiction

Consumer customers (private individuals): jurisdiction lies with the court of the Customer’s residence or domicile, in accordance with the Consumer Code.
Professional customers or companies: exclusive jurisdiction of the Court of Crotone, Italy.

20. Changes

Impresa Individuale Gerace Pasquale may amend the GTCS at any time; changes apply to orders placed after publication.

21. Data Protection

Data processing is governed by the Privacy Policy.
